Councillor disqualified under Local Government Act

The Shire of Capel Chief Executive Officer has issued a notice of disqualification to Mr David Clews, advising him that he has been disqualified from continuing as a Councillor at the Shire of Capel. The notice was required and given in accordance with the Local Government Act 1995 (Act), Section 2.25 Disqualification for failure to attend meetings.

 

(4) A member who is absent, without obtaining leave of the council, throughout 3 consecutive ordinary meetings of the council is disqualified from continuing his or her membership of the council, unless all of the meetings are within a 2 month period.

The notice was required and given due to the former Councillor’s absence at three consecutive ordinary Meetings of Council as follows:

21 December 2022, 6:00pm, Shire of Capel Council Chambers. 25 January 2023, 6:00pm, Shire of Capel Council Chambers. 22 February 2023, 6:00pm, Shire of Capel Council Chambers.

The Notice of Disqualification is effective immediately and prevents Mr Clews representing the Council or himself as a Councillor in any capacity, unless he is able to demonstrate or have the State Administrative Tribunal declare, he is not disqualified.

The Shire would like to thank Mr. Clews for his service to the Council since 2019, as well as his contributions to our committees including chairing the Climate Change Adaptation and Sustainability Committee.
