The West Tamar draft Local Provisions Schedules (LPSs) were submitted to the Tasmanian Planning Commission (TPC) on 5 December 2019 and post lodgement, approval was given on 2 February 2021 to publicly exhibit the draft LPSs for 60 days.

“We’re pleased to be able to share the Draft Local Provisions Schedules with our community and receive their feedback.  The LPSs will enable the implementation of the Tasmanian Planning Scheme in the West Tamar and direct the future planning in our region for years to come,” Mayor Holmdahl said.

 

This is part of the Tasmanian Government’s reform of the State’s planning system to implement a single planning scheme, the Tasmanian Planning Scheme, which is made up of the State Planning Provisions (SPPs) and the Local Provisions Schedules (LPSs).

The SPPs are designed to provide a consistent set of planning rules and provides for 23 zones and 16 codes that apply State-wide, making up a suite of controls that are to be applied by local councils.

The LPSs include zone and overlay maps (indicating where the zones and codes apply), local area objectives, code lists, particular purpose zones, specific area plans, and any site-specific qualifications. Each Council is responsible for preparing the LPSs for their municipal area.

The draft LPSs will be publicly exhibited from 22 February 2021 to 30 April 2021.

 

“Overall, there have not been significant changes to zoning, however people in rural resource and rural living areas in particular should check what changes might have been made to their zones, as the Tasmanian Planning Scheme has introduced new requirements in these areas,” Mayor Holmdahl said.

The Land Use Planning and Approvals Act 1993 (The Act) provides that any person can make a representation (submission) on the draft LPSs within the exhibition period. Representations must be in writing and sent by email to [email protected] or post to the West Tamar Council, PO Box 16, Riverside TAS 7250. They should also include their name and contact details (email or postal address).

Representations can be made regarding the Local Provisions Schedule but cannot be made about the State Planning Provisions which contain most of the regulatory provisions for zones and codes – including minimum lot sizes and development controls. Representations must be received by 5pm on 30 April 2021.

Council will consider representations received and provide a report to the Tasmanian Planning Commission on those representations. The TPC will undertake a statutory assessment of the draft LPSs, the representations on the draft LPSs together with other matters it is required to consider about each draft LPS.
