Notice of Intention to Lease: Hangar 2 Benalla Airport

Benalla Rural City Council gives notice under section 190 of the Local Government Act 1989 (the Act) of its intention to enter into a lease with David Boyce in respect of the premises described below (Proposal).

The premises are known as Hangar 2, Benalla Airport, Samaria Road, Benalla 3672.

The proposed principal terms of the lease are:

A term of five years commencing 1 July 2019 with an option for four further terms of five years. A commencement rent of $5.09 per square metre of the area of the Premises (plus Fire Services levy) per annum plus GST. Rent is to be reviewed annually by CPI adjustment on each anniversary of the commencement date of the lease, except for on the 5th anniversary of the commencement date of the lease on which the rent will be reviewed to market value.

The premises are known as Hangar 3, Benalla Airport, Samaria Road, Benalla 3672.

The proposed principal terms of the lease are:

A term of five years commencing 1 July 2019 with an option for four further terms of five years. A commencement rent of $5.09 per square metre of the area of the Premises (plus Fire Services levy) per annum plus GST. Rent is to be reviewed annually by CPI adjustment on each anniversary of the commencement date of the lease, except for on the 5th anniversary of the commencement date of the lease on which the rent will be reviewed to market value.

A person may make a submission on either Proposal under section 223 of the Act and must do so by Wednesday 31 July 2019.

Submissions should be addressed to the Chief Executive Officer and can be:

Any person who lodges a written submission may request in their submission that they wish to appear in person, or be represented by a person specified in their submission, at a meeting to be heard in support of their submission.

Submitters will be identified in a public report to the Council on submissions received. This information will become part of the public record. If you do not want to be identified, please indicate this in your submission.

Submissions will be heard at a meeting of the Planning and Development Committee on Wednesday 21 August 2019 at the Benalla Civic Centre (Council Meeting Room), 13 Mair Street, Benalla commencing at 6pm.
